This privacy policy (the “Policy”) describes how Tecnica Group USA Corporation, a company incorporated in the State of New Hampshire, having its registered office at 19 Technology Drive, West Lebanon, NH 03784, processes the personal data of its customers. Please note that personal data processing activities for marketing purposes are performed by Tecnica Group S.p.A. based on a specific data protection notice (see below for further information).

  1. Scope of this Policy.

This Policy applies to the personal information that Tecnica Group USA Corporation processes when you interact with us as a customer for the provision of our products and services.

Tecnica Group USA Corporation collects personal data directly from you when you interact with us and from third parties.

    • identifiers (e.g., name, phone number, address, email address, etc.);
    • details on the products and services requested or purchased, including sizes from which we can derive some of your physical characteristics;
    • financial information regarding payments and billing details related to the purchasing of our products and services;
  • personal data provided from third parties with which you may interact in the context of provision of our products and services (e.g., couriers, payment services providers, etc.).

Tecnica Group USA Corporation processes your personal data for the following purposes:

  • to provide you with our products and services and to provide feedback to your requests. We will use your personal information to provide the requested product or service. For example, if you make a purchase, we will use your personal information to fulfill your order and complete the transaction;
  • to operate, improve and maintain our business, products, and services. We use the personal information you provide to us to operate, improve, and maintain our business, products, and services. We retain your personal information for as long as reasonably necessary to fulfill the purposes described in this policy or disclosed to you at the time of collection, unless otherwise required or permitted by law.

INFORMATION ON PERSONAL DATA PROCESSING FOR MARKETING PURPOSES

Tecnica Group S.p.A. (Italian business register and tax code: 00195810262), with legal headquarter in via Fante d’Italia, 56 (31040) Giavera del Montello (TV) – Italy (the “Company”) provides you with the following information on the processing (the “Processing”) of your personal data (the “Data”) in the context of marketing activities. 

  1. Identity and contact details of the controller (the “Controller”). 

The Controller is the Company, which can be contacted at the e-mail address privacy@tecnicagroup.com

  1. Contact details of the data protection officer (the “DPO”). 

The DPO can be contacted at the e-mail address dpo@tecnicagroup.com

  1. Purposes and legal bases of the Processing. 

The Data will be processed: 

  • to send you direct marketing communications, including customer surveys and market research questionnaires, related to the products, services, and initiatives managed by the Company. The related legal basis of the Processing is your consent; 
  • to analyse your customer profile to provide you with marketing communications and offers fitting such profile, or to tailor your customer and user experience based on the same profile. The related legal basis of the Processing is your consent; 
  • to comply with legal obligations applicable to the Company. The related legal basis of the Processing is the need to comply with legal obligations applicable to the Controller; 
  • to exercise and defend the Company’s legal rights. The related legal basis of the processing is the Controller’s legitimate interest to protect its legal rights. 

The provision of Data for such purposes is completely free and optional. 

  1. Categories of recipients of the Data. 

The Data may be shared with: 

  • business partners and service providers which activities are functional to the pursuit of the above indicated purposes; 
  • other entities of our group of undertakings for administrative purposes; 
  • public authorities and entities to comply with legal obligations or to exercise and defend legal rights. 

Should any of these recipients be located outside the European Economic Area, the transfer of Data will comply with all applicable legal requirements, considering the case law of the European Union Court of Justice and the recommendations of the European Data Protection Board on this matter. 

  1. Data retention period. 

Data will be stored for twelve months for customer profiling purposes and twenty-four months for marketing purposes. Nevertheless, should the Data need to be further stored to comply with legal obligations and/or to exercise and/or defend the Company’s legal rights, the retention period will be extended for the time strictly necessary to reach such purposes. 

  1. Your rights. 

By contacting the Company, You have the right to request access to and rectification or erasure of Data or restriction of Processing or to object to Processing as well as to exercise the right to data portability. Also, You have the right to withdraw consent to the Processing at any time, without affecting the lawfulness of Processing based on consent before its withdrawal. 

Furthermore, You have the right to lodge a compliant with the relevant supervisory authority (for Italy, the Garante per la Protezione dei Dati Personali).
